When our daughter Dorothea suffered a hidden emergency and a brain injury during her catheterization at Gaslini—followed by a 10-tooth unconsented dental surgery—we did what any parents would do:

We asked questions. We sought the truth. We tried to protect her.

We hoped to re-establish trust with the hospital, to prepare for her next critical open-heart surgery. But Gaslini's priority has never been Dorothea—it has been protecting itself. Even when faced with forensic proof of forged consent and signs of untreated intraoperative trauma, they gave us no answers.
 

We came to Genoa for Dr. Guido Michielon, one of the most skilled pediatric cardiac surgeons in Europe. We trust him.

But we cannot trust the system around him.

It would be reckless to let Gaslini open our daughter’s chest again under these conditions. Dorothea deserves unbiased, patient-centered care—not silence, denial, or institutional fear.

Only a handful of hospitals in the world can handle her rare heart defect, brain injury, and urgent surgery.

We must get her there—now. Her life depends on it.

Her Legal Right
to Life-Saving Care Abroad

EU Law – Directive 2011/24/EU

Every EU citizen has the right to access healthcare in another EU or non-EU country and be reimbursed by their home system when appropriate treatment is not available locally, or when delay would endanger life or health.

  • Dorothea qualifies because Italy is refusing accountability, and time-sensitive surgery is required.

  • This is not optional. It is a legal right.

Italian Law – Constitution & Health Code

  • Art. 32 of the Italian Constitution guarantees the right to health as a fundamental right of the individual.

  • Law 833/1978 allows public funding for medical care abroad when treatment is not accessible or safe within Italy.

Gaslini has not provided safety, transparency, or accountability.
 

Dorothea is entitled to immediate approval for care abroad—and any delay is a violation of her fundamental rights.

What’s Needed

For the transfer to happen:

  1. Gaslini must acknowledge they cannot provide care, or

  2. The health authority (ASL3 or Liguria Region) must approve her referral to an accepted foreign center, such as CHOP in Philadelphia.
     

Right now, no one is taking responsibility—and that silence is costing time we do not have.

We Have Tried Everything
— And Been Met With Silence

Gaslini Hospital

We asked Gaslini for answers.
We demanded to know what happened to our daughter.
We sent certified legal letters asking for:

  • A referral letter acknowledging they could not treat her,

  • An explanation for the unauthorized dental surgery,

  • A response to evidence of a concealed intraoperative emergency,

  • Medical record corrections after proven consent forgery.

They never answered.

They know she needs urgent life-saving surgery,
but continue to deny, delay, and remain silent.

Legal Action in Italy

We filed formal criminal complaints for:

  • Forgery of consent,

  • Unauthorized surgery,

  • Concealment of emergency and brain injury,

  • Institutional negligence.

Italian Health System & ASL3

We contacted ASL3 repeatedly—the local health authority responsible for Dorothea.

We asked them to:

  • Take responsibility for her care,

  • Acknowledge Gaslini’s refusal to treat,

  • Approve her cross-border transfer under EU law.

They have done nothing.

Polish Government

Dorothea is a Polish citizen and entitled to protection under Polish and EU law.

We contacted the Polish Consulate in Milan many times.
They reached out to Gaslini. Gaslini told them we had the records and were free to go—
without offering the referral required for transfer.

The Consulate confirmed this, but could not force further action

Hospitals Across Europe and the U.S.

Dorothea's condition is highly complex and Ultra High Risk

  • 2 Tops US Hospitals have accepted her for Surgery.
     

  • NO EU Hospital has accepted and very few can actually handle her case effectively.

Certified Legal Letters and PEC

We sent over a dozen PEC-certified legal letters to:
 

  • Gaslini,

  • ASL3,

  • Ministry of Health,

  • Ligurian regional authorities.

We demanded:

  • Accountability,

  • Medical record corrections,

  • Urgent transfer authorization.

They never responded.

We contacted:

  • Italian investigative reporters,

  • TV programs,

  • Global news outlets,

  • Medical ethics advocates.

 

Zero progress.

Italian Politicians

We contacted:

  • The President of the Republic,

  • National health ministers,

  • Parliamentary figures involved in cross-border care.

  • Every possible government email we could find.
     

No one has responded or intervened.

Global Institutions

We reached out to:

  • UNICEF,

  • The United Nations in Geneva,

  • EU bodies for child and patient rights,

  • NGOs focused on cross-border health and medical abuse.

No institution has stepped in to help.

Now we must fight for her Life!

Dorothea needs a life saving open heart surgery (fontan) when she turns 3 years old on July 7th 2025.

  • Dorothea’s current hospital refuses to acknowledge its mistakes or guarantee her safety.

  • No hospital in the EU has yet agreed to take her.

  • A leading U.S. hospital has accepted her for urgent, life-saving surgery.

  • The Italian health system and government remain silent—ignoring her worsening condition.

  • We don’t have time to wait for civil or criminal courts to act.

  • The only path forward is faith, urgent action, and unity.
    Together, we must either:

    • Pressure the Italian Health Service to approve the transfer and cover her care—as required by law.

    • If all fails attempt to raise money to self fund the surgery.

      One way or another we must Save her Life.
